LGBT Immigration Help: Information and Tips for Same-Sex Couples

About Our Law Practice

Our client service model focuses on providing thorough and practical legal advice, being responsive to our clients’ calls and e-mails, and being actively involved in all aspects of our clients’ cases.

With many immigration law practices, especially large practices, advertising low-cost visa and immigration services, you may never actually speak to or meet with an actual attorney.  It is both amusing and sad to be in the waiting room at USCIS with clients and have attorneys enter the room and call out the name of their client or clients, making it obvious that they are meeting for the first time just a few minutes prior to their interview or appearance.

By contrast, Brophy & Lenahan P.C. has only two attorneys:  Alex Brophy and Kate Lenahan.  Alex and Kate will be the only people you ever speak to about the substance of your case.  No legal assistants, no paralegals, no case managers, and no notarios will stand between you and your lawyers:  you will have direct access to your attorney, an attorney who knows you and has a thorough understanding of every aspect of your case.

So, without further ado, here’s who you’ll be working with at our firm:

Alex began his legal career over ten years ago as a judicial law clerk at the United States Court of Appeals for the Second Circuit, which decides final immigration appeals (“petitions for review”) for immigrants residing in New York, Connecticut and Vermont, among other types of cases.

After completing his clerkship, Alex worked for several years at a prestigious law firm in New York, where he focused mostly on litigation involving corporations and learned how to function with limited sleep.  But in doing so, Alex learned how to practice law in a creative, detail-oriented manner, and the importance of a client-focused approach to practicing law where listening and quickly responding to a client’s needs is of the utmost importance.

After some time, Alex wanted to shift the focus of his practice to individuals, not corporations.  So, after leaving his old firms, Alex and Kate opened their own law practice, Brophy & Lenahan P.C.  Alex still practices litigation today, particularly litigation to protect the rights of individuals who have been discriminated against, but has also devoted a substantial part of his practice to immigration law, particularly on behalf of LGBT couples.  Alex has represented many LGBT couples in immigration proceedings in several U.S. states.

Alex also maintains a robust removal defense practice and appellate immigration practice.  He has won several recent Immigration Court matters on behalf of individuals who fled persecution in their home countries.

Alex is a summa cum laude graduate of the University of Miami School of Law, where he finished as the fifth-ranked student in a graduating class of nearly 300.  (Of course, he is often asked if he is crazy for leaving sunny Miami to return to the Northeast).  Before that, Alex earned a Bachelor of Arts degree in International Studies from Johns Hopkins University.

Alex is admitted to practice law in New York and Pennsylvania, as well as in several federal courts.  Because immigration law is federal, Alex can represent immigration clients in all 50 states -- even the red states.  Alex is also a member of the American Immigration Lawyers Association (“AILA”)

In a past life, Alex fancied himself to be a comedian, as you might have gathered from reading all of the attempts at humor in his biography.

KATE LENAHAN

(212) 203-0557 (NY)

KATE@BROPHYLENAHAN.COM

After graduating from law school, Kate served as a Legal Fellow at Immigration Equality, an organization dedicated to advocating for and assisting LGBT and HIV-positive immigrants to obtain immigration rights.  Kate absolutely loved her work and her clients while at Immigration Equality, and won asylum on behalf of several of her clients.

Unfortunately, Kate’s law school loans needed to be tamed a bit, so Kate left Immigration Equality to join a large law firm in New York, where she focused on the exciting world of corporate bankruptcy.  Even then, Kate continued doing pro bono work for Immigration Equality.

When the thrills of corporate bankruptcy became too much for Kate to handle, she and Alex opened Brophy & Lenahan P.C., where she works almost exclusively on immigration law, with a focus on helping LGBT immigrants who had been discriminated against for many years due to DOMA.

Since DOMA was struck down in June 2013, Kate has worked with dozens of LGBT couples and individuals to obtain permanent residence in the United States, some of whom had waited decades for the opportunity to petition for their spouse’s green card.  It has been very rewarding work.

Kate is a cum laude graduate of Brooklyn Law School, but does not have a Brooklyn accent.  Before that, Kate graduated from Bryn Mawr College with a Bachelor of Arts degree in Political Science.  While at Bryn Mawr, Kate spent an extremely studious year abroad in Madrid, where she became a proficient Spanish speaker (although she now describes her Spanish as “rusty” proficient).

Kate is a member of the American Immigration Lawyers Association (“AILA”), as well as AILA’s GLBT interest group.  She is also admitted to practice law in New York and Pennsylvania, and authorized to represent immigration clients in all 50 states.

Aside from (and perhaps because of) practicing law, Kate is a wine enthusiast, and is presently working on obtaining her wine certification.

To arrange a consultation with Kate about your legal matter, please e-mail her or call her at (212) 203-0557 (NY) or (215) 558-7600 (PA).

Some of our clients have initially expressed hesitation about hiring an attorney to help with their immigration case.  While there are many excellent attorneys practicing law, not everyone has had a good experience with hiring a lawyer.  What’s more, in the immigration field, there are actually people posing as attorneys (a.k.a. notarios, as well as some document preparation services) who are not licensed to practice law!  So, before you consider hiring us, here is some information about who you are working with.
